Our Terms and Conditions of Sale
WE STRONGLY RECOMMEND THAT YOU READ THESE TERMS AND CONDITIONS BEFORE CONFIRMING YOUR ORDER. BY CONFIRMING YOUR ORDER, YOU WILL BE DEEMED TO HAVE ACCEPTED THEM. DO NOT CONFIRM YOUR ORDER IF YOU DO NOT ACCEPT THESE TERMS AND CONDITIONS.
1. The contract between us
These terms and conditions govern all transactions between us for any sale of goods, retreats, or services by us to you. Please read them carefully.
To order goods, retreats, or services from us you certify that you are at least 18 years of age.
When you place an order to purchase goods or services from the site, and we have approved your payment details, we will confirm that your order has been accepted by sending an e-mail to you at the e-mail address you provided on your order form. If you do not receive such an email, please contact us.
These terms and conditions, together with the prices displayed on our web site, shipment details, product details, contact details, and any document expressly referred to in these terms and conditions, set out the whole of our agreement relating to the sale of goods and/or services by us to you.
2. Description & availability
All drawings, pictures, images, descriptive material, specifications and advertising on our web site are for the sole purpose of giving an approximate description of the goods or services in order to assist your purchasing decision. All goods and services advertised are strictly subject to availability.
3. Product guarantee
All products are guaranteed against defects for 30 days from the date of shipment of the goods.
We make no representations or warranties, either express or implied, of any kind with respect to products or services sold, including fitness for a particular purpose.
4. Cancellation by us
We reserve the right to not ship the goods or deliver any services in the event:
There are import restrictions on goods to the country in which you require delivery.
Your payment is refused or not authorized.
You may receive a refund of any goods received by you by returning the unused goods you have ordered within 30 days from the date they are shipped. You do not need to give us any reason for canceling your order nor will you have to pay any penalty other than delivery charges incurred.
Once you have notified us that you desire a refund within the 30-day time period, any sum debited by us from your credit card will be re-credited to your account, less any delivery charges, within 10 business days of your returned goods being received, PROVIDED THAT the goods in question are returned by you (at your expense) and received by us in the condition they were in when delivered to you.
6. Delivery of goods to you
We will deliver the goods ordered by you to the address you give us for delivery at the time you make your order.
You can normally expect delivery of the goods within 5-7 days of placing your order with standard shipping selected. However, most of the time, the goods are shipped from our facility within 1-3 days after receiving the order. Delay in delivery is sometimes outside of our control. Any dates we give you for delivery are approximate only.
7. Limitation of Liability
If the goods we deliver are not what you ordered, or are damaged or defective prior to the point of delivery, or the delivery is of an incorrect quantity, and provided that you have notified us accordingly within 30 days of shipment, our only obligation, at your option, will be:
to make good any shortage or non-delivery; or
to replace or repair any goods that are damaged or defective; or
to refund to you the amount paid by you for the goods in question.
FOR GOODS (i.e. electronics, products, or clothing) OR SERVICES (i.e. guide, repair, or instructional) DELIVERED OR PROVIDED TO YOU, WE SHALL NOT BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, SPECIAL, OR CONSEQUENTIAL LOSS OR DAMAGE OR FOR ANY DEATH OR PERSONAL INJURY. OUR ENTIRE LIABILITY, NO MATTER THE CLAIM OR CAUSE OF ACTION, IS LIMITED TO THE AMOUNT YOU PAID FOR THE GOODS OR SERVICES.
Failure by us to enforce any of these terms and conditions will not affect our right to enforce any of the remaining terms and conditions.
If any of these terms and conditions are unenforceable, the enforceability of any of the remaining terms and conditions shall not be affected.
The contract between us shall be governed by, and interpreted in accordance with, the laws of the state of Colorado and the courts of Colorado shall have exclusive jurisdiction to resolve any disputes between us, except that we may seek an injunction proceeding for any misuse of our intellectual property in the jurisdiction where you reside.
The contract specified above is by and between you and OutdoorsGeek.com. With respect to limitations on liability expressed in section 6, you agree that they are a third-party beneficiary of this contract between us.
9. Rental Policies
Outdoors Geek rentals are subject to the following terms and conditions. We keep things straight forward and easy for you. Rental gear is also subject to all other terms and conditions.
Your start date is the day you need your equipment. We will ship your gear so it arrives the day before your start date. The beauty of this system is that if shipping is delayed by a day for some reason, the equipment will still arrive on your start date. For this reason, we do not accept Saturday or Sunday start dates.
Since you can also pick your equipment up from us directly, you can have some control over your start date. We schedule pickups by appointment so shoot us an email or give us a call. And yes, if you are wondering, you may be able to pick up your gear the afternoon before your start date.
This is the day you must either drop your gear off with us or drop it back into UPS. You can drop you gear into UPS at any UPS store or possibly even at your place of business.
Cleanliness is next to Godliness
Don’t forget, all gear must be returned clean (meaning not full of dirt) and dry (meaning dry). If you don’t return gear clean and dry, we will charge you an additional fee. Mold and mildew can do a lot of damage and we don’t want to charge you for it.
Calculating Length of Rental
If your start date is a Friday, and you come back to civilization on a Sunday, we consider that three days. We are also aware this means that you cannot return it to us or put it in UPS until Monday. Don’t worry; according to the Geek’s math, that is still a three day rental. Don’t forget though the rental start dates are never on Saturday or Sunday. If none of this really makes sense, give us a call for a quick course of Geek math.
Don’t be late
We make commitments knowing that you will send your gear back on time….:) If for some reason this doesn’t happen, we will charge you a daily fee equal to the three day rental fee divided by three. This adds up pretty quickly and we don’t want you to be surprised by it. At some point, the total fee could reach the total amount we reserved on your credit card to cover lost and damaged gear. When that happens, we will quit charging you and you can keep the gear.
The Outdoors Geek crew has done a lot of camping and backpacking and we know all about normal wear that comes with usage. However, we also know the kind of gear we carry lasts for years and years. With that in mind, rips and tears, stains and missing parts, and dents etc will be charged against your deposit.
Lost or Stolen Gear
When you rent gear, it is your responsibility to get it back to us. If we don’t get it back, we will need to charge you.
Please reserve your gear as far in advance as possible. We will run out of some items during busy times and if you cannot pick up from us, it will take 2-5 days to get to most US addresses via UPS.
If you cancel two weeks or more in advance of your rental period, we have a "go in peace" policy......no charge. If you cancel less than two weeks in advance, we will charge you in full. Group rentals are more restrictive and may incur larger cancellation fees.
